Terms of Service

1. What FenalClips does

FenalClips takes videos you upload, transcribes them, uses AI to suggest short clips, and turns the clips you choose into vertical videos with captions and suggested post text. Features may change as we improve the product.

2. Who can use it

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use FenalClips for a business, you confirm you're allowed to accept these terms for it.

3. Your account

Keep your login details private and tell us at superstarslash@gmail.com if you think someone else has accessed your account. You're responsible for what happens in your account.

4. Your content

You keep ownership of everything you upload and everything FenalClips makes from it. To provide the service, you give us a limited permission to store, process, transcribe, analyze, edit and render your content, and to send it to the service providers listed in our Privacy Policy for those purposes only. This permission ends when you delete the content or your account, except as needed to complete deletion.

You confirm that, for everything you upload:

• you own it, or you have permission from whoever does (for example, the creator or a campaign you're clipping for) to upload it, edit it and post clips of it;
• you have any permission needed from people who appear or speak in it;
• it doesn't break the law or anyone else's rights.

Clipping other people's content is your responsibility. FenalClips is a tool; it doesn't grant rights to anyone's content.

5. What you can't do

• Upload content you don't have the rights to, or that infringes copyright, trademarks, privacy or publicity rights.
• Upload illegal content, sexual content involving minors, or content that harasses, threatens or promotes violence or hate.
• Use FenalClips to make misleading content that impersonates people or deceives viewers about who is speaking.
• Try to access other users' data, break or overload the service, get around limits, or reverse engineer it.
• Use automated scripts to access FenalClips, other than through features we provide for that.
• Use the service in ways that break the usage policies of the AI providers it relies on.

We may remove content or suspend accounts that break these rules.

6. AI suggestions are suggestions

Clip picks, scores, titles, captions, hashtags, speaker detection and Campaign Mode checks are generated by AI. They can be wrong, and an AI score is not a prediction or promise of views, followers, income or virality. Review everything before you post.

Campaign Mode helps you check clips against a campaign's rules, but it isn't legal advice and doesn't guarantee a campaign will approve or pay for a clip. You're responsible for following each campaign's brief, each platform's rules, and advertising law, including clearly disclosing paid or sponsored content (in the US, the FTC's rules on endorsements).

7. Copyright complaints

If you believe content on FenalClips infringes your copyright, send a notice to superstarslash@gmail.com with: your contact details; the work you believe is infringed; where the content is on FenalClips; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and you're the owner or authorized to act for the owner; and your physical or electronic signature.

Our designated copyright agent can be reached at the same address. We remove infringing content when properly notified, and we close the accounts of repeat infringers.

8. Credits and payments

Processing a video uses credits: 1 credit covers up to 1 hour of video, rounded up (a 2-hour 10-minute video uses 3). New accounts get 1 free credit. Prices are shown before you pay. Payments are handled by Stripe; we don't see or store your full card details.

Credits are set aside when an upload starts, based on the length your browser reads from the file, and corrected to the real length once the video is transcribed. If a video can't be processed (for example, the upload is interrupted or transcription fails), its credits are returned automatically.

Credits don't expire while your account is open, have no cash value, and can't be transferred. If you delete your account, unused credits are lost. For questions about a purchase, contact us at the address below.

9. Ending your use

You can delete projects, or your whole account from your account settings, at any time; see our Privacy Policy for what deletion removes. We may suspend or close accounts that break these terms or put the service or other users at risk, and we may change or stop the service. If we stop it entirely, we'll give reasonable notice so you can download your clips.

10. No warranties

FenalClips is provided “as is” and “as available”. To the extent the law allows, we don't promise it will be uninterrupted, error-free, or that it will meet your needs, and we disclaim implied warranties such as merchantability and fitness for a particular purpose. Keep your own copies of anything important.

11. Limits on our liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, views or business opportunities. Our total liability for any claim about FenalClips is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.

12. Your responsibility to us

If someone makes a claim against us because of content you uploaded or how you used FenalClips in breach of these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.

13. Changes to these terms

We may update these terms. If a change is significant, we'll let you know before it takes effect, for example by email or a notice in the app. Continuing to use FenalClips after that means you accept the updated terms.

14. Law and disputes

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Please contact us first so we can try to sort out any problem informally.
